                   	     ORDINANCE NO. 9467
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING CARNEGA
                   STREET AND AN ALLEY LOCATED SOUTHEAST FROM
                   HIGHLAND PARK AVENUE, BETWEEN EAST 3RD STREET
                   AND EAST 5TH STREET, MORE PARTICULARLY
                   DESCRIBED HEREIN, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned Carnega Street and an alley located southeast 
from
         Highland Park Avenue, between East 3rd Street and East 5th 
Street,
         more particularly described herein, and as shown on plat 
attached
         hereto and made a part hereof by reference:
               
                Carnega Street, a 25 foot wide unopened
                right-of-way, of which to find the true point of
                beginning, start on the southeast line of Highland
                Park Avenue 217 feet northeast of the intersection
                of the southeast line of Highland Park Avenue with
                the northeast line of East 5th Street, said point
                also being the intersection of the southeast line
                of Highland Park Avenue with the southwest line of
                a 15.5 foot unopened alleyway, thence southeast 175
                feet with the southwest line of said alley to the
                northwest line of Carnega Street, the true point of
                beginning, thence northeast 165.5 feet parallel to
                Highland Park Avenue, thence southeast at a right
                angle 25 feet, thence southwest 165.5 feet parallel
                to Highland Park Avenue, thence northwest at a
                right angle 25 feet to the true point of beginning. 
                Said street separates lots 21, 23, 25, 27, 29 and
                31, W.D. Smartt's Subdivision of Lots 80, 81, 82
                and 83, East End Syndicate's Addition to
                Chattanooga, as shown by plat of record in plat
                book 4, page 38, R.O.H.C., from lot 97, and part of
                lot 96, End End Syndicate's Addition to
                Chattanooga, as shown by plat of record in plat
                book 1, page 13, R.O.H.C.
               
                A 15.5 foot wide unopened alleyway beginning on the
                southeast line of Highland Park Avenue 217 feet
                northeast of the intersection of the southeast line
                of Highland Park Avenue with the northeast line of
                East 5th Street, and extending southeast 200 feet
                between parallel lines to the southeast line of
                Carnega Street.  Said alleyway separates lots 30
                and 31, W.D. Smartt's Subdivision of Lots 80, 81,
                82 and 83, East End Syndicate's Addition to
                Chattanooga, as shown by plat of record in plat
                book 4, page 38, R.O.H.C., from lots 10, 11, 12,
                13, 14, 15 and 16, Amiss Subdivision of the north
                50 feet of Lot 84 and the south 71.25 feet of Lot
                85, East End Addition, as shown by plat of record
                in plat book 2, page 29, R.O.H.C.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. Resubdivision of adjacent properties to prevent
                   any land-locked parcels.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this
         Ordinance shall take effect two weeks from and after its 
passage
         as provided by law, provided, however, that this Ordinance 
shall
         not be operative until completion of the condition in Section 2 

         above.
